JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-02-2018 Heard the learned counsel for the petitioners and learned counsel for the State.

The petitioners seek anticipatory bail in connection with Bhabua (Sonhan) PS case no. 643 of 2017 dated 12.10.2017 registered for the offences punishable under Sections 341, 323, 307, 504, 504 and 34 of the Indian Penal Code. The allegation is that upon instigation by the petitioners herein, the co-accused Ashok Yadav tried to kill the informant, but the informant sustained injury on his hand.

The learned counsel for the petitioners submits that there is no allegation whatsoever as against the petitioners herein of assaulting the informant. The petitioners are said to be having a clean antecedent.

No.10542 of 2018 (2) dt.23-02-2018 2/2 Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioners above named are directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua, District Kaimur at Bhabua in connection with Bhabua (Sonhan) PS case no. 643 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
