JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Khutauna P.S. Case No. 37 of 2016, dated 03.06.2016, instituted for the offence punishable under Section 392 of the Indian Penal Code.
The informant of this case was waylaid and his personal belongings were taken away. Later, one of the looted articles, viz. a mobile phone is said to have been found in the possession of the father of the petitioner. Mr. Pramod Mishra, learned Advocate for the petitioner has submitted that the petitioner has been working in Noida (U.P.) with Barda Builders Pvt. Ltd., since 2016.

No.15929 of 2018 (2) dt.09-04-2018 2/2 Nothing has been recovered from the possession of the petitioner and it is not known whether the father of the petitioner purchased the looted mobile phone from anybody, who did not disclose that it was a stolen property. The petitioner earlier was made accused in one case in which he was acquitted.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, DistrictMadhubani in connection with Khutauna P.S. Case No. 37 of 2016.
