JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This application, for grant of anticipatory bail, arises out of C.R. No. 67/2010 (Trial No. 778/2018), disclosing offences under Sections 406, 420 and 323 of the Indian Penal Code.

As per complaint case, allegation against the petitioners is that they have purchased the Government land in collusion with authorities concerned.

Submission of learned counsel for the petitioners is that out and out false and fabricated case has been lodged and petitioners have purchased the land from the land holders, which are not Government lands. Further submission is that they are

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Benipur, Darbhanga, in connection with C.R. No. 67/2010 (Trial No. 778/2018), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
