JUSTICE SANJAY PRIYA ORAL ORDER 09-04-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner apprehends his arrest in Ramgarhwa P.S. Case No. 250 of 2017 instituted for the offence under Sections 341, 323, 307, 504/34 of the Indian Penal Code, Sections 25(1-b), a, 26, 27 and 35 of the Arms Act.

It has been submitted that petitioner is not named in the written report. His name has been taken by the witness during investigation.

Learned counsel for the informant has submitted that name of this petitioner has been taken by the injured Md. Meraj and also other witnesses in paragraph 28 and other paragraphs of

Patna High Court Cr.Misc. No.12502 of 2018 (3) dt.09-04-2018 2/2 the case diary. The injured have levelled specific allegation against this petitioner that he along with other eight accused persons caused firearm injury to him.

Case diary has been received.

The injury report of the informant along with other injured is available in the case diary wherein the Doctor has found four injuries on the person of injured caused by firearm and pellet was found intact in the body of the injured.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
