The petitioner seeks bail in connection with Sour Bazar (O.P. Baijnathpur) P.S. Case No. 543 of 2018, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Sections 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that there is admitted land disputed between the parties and nothing has been recovered from the possession of the petitioner. The petitioner is in custody since 16.07.2019.

Learned A.P.P. appearing for the State submits that there is specific allegation of firing against the petitioner and the

Patna High Court CR. MISC. No.64584 of 2019(2) dt.08-11-2019 2/2 death caused to the deceased due to fire arm injury. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.

Accordingly, this application is rejected.
