The petitioners seek bail in a case registered for offences under Section 420 of the Indian Penal Code and Sections 30 (a), 38 and 41of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 2581.92 litres of foreign liquor were allegedly recovered from the truck. It is further contended that the petitioners are not named in the First Information Report and on the basis of confessional statement of co-accused, Chandan Kumar they have been
Patna High Court Cr.Misc. No.39898 of 2017(2) dt.25-08-2017 2/2 implicated in this case and also on his confession, the petitioners have been made accused in another case, i.e., Kargahar P.S. Case No. 124 of 2017. Petitioners claim that they are having clean antecedent and are in custody since 13.06.2017. Considering the facts and the circumstances of the case, the petitioners, above named are directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Rohtas at Sasaram in connection with Sasaram (Model) P.S. Case No. 112 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
