JUSTICE RAKESH KUMAR ORAL ORDER 13-02-2018 Heard Shri Ramchandra Sahni, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Daraunda P.S. Case No. 170 of 2017 registered for the offence under Section 395 of the Indian Penal Code 1860 has prayed for grant of anticipatory bail Learned counsel for the petitioner submits that petitioner's name has come in the confessional statement of the co -accused and as such, petitioner deserves to be released on anticipatory bail, whereas from the FIR it is evident that informant in the present case is of Uttar Pradesh and in his presence while accused persons after committing dacoity started fleeing away one of the accused was apprehended by the villagers and in his presence the apprehended accused disclosed the name of
Patna High Court Cr.Misc. No.7068 of 2018(2) dt.13-02-2018 2/2 other accused persons including the petitioner. Considering the fact that there is specific accusation against the petitioner that too in a case relating to dacoity, there is no reason to extend the privilege of anticipatory bail The petition stands dismissed.
