The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 3 litres of Nepali liquor were allegedly recovered from the bag which was being carried by the petitioner. It is further contended that the petitioner is accused in one other case, i.e., Bela P.S. Case No. 62 of 2017 for the offences under Sections 272 and 273 IPC and Section 30(A) of Bihar Excise Act. Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Sitamarhi in connection with Bela P.S. Case No. 164 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
