Petitioners are apprehending their arrest in connection with Tisiauta P.S. Case no.23 of 2019 registered for offence punishable under Sections 341, 323, 307, 427, 436, 504 and 506/34 of the Indian Penal Code.
As per F.I.R. allegation against the petitioners is that all accused persons joint set the house of Bhuneshwar Paswan at ablaze and with intention to kill the informant, hurled a Farsa blow upon him causing cut injury on his head. Submission of learned counsel for the petitioner is that there is case and counter case in between the parties and the injury caused to the informant does not corroborate with the
Patna High Court CR. MISC. No.71066 of 2019(2) dt.07-11-2019 2/2 allegation made in the First Information Report. He submits that co-accused persons have been granted anticipatory bail vide order dated 23.07.2019 passed in Cr.Misc.No.44996 of 2019. Heard learned Addl. Public Prosecutor also.
Having heard both sides and in view of facts and circumstances, as stated above, let both petitioners, named above, in the event of their arrest or surrender before the court below be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipr in connection with Tisiauta P.S. Case No.23 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
