JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-02-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Bihpur (Jhandapur) P.S. Case No.124 of 2017 registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the informant and the petitioners are own agnates and apparently they have fight for a land dispute. Although in the FIR there are allegations against all the accused persons of committing assault by lathi, however specific allegation of assault on the head of the
Patna High Court Cr.Misc. No.2831 of 2018 (3) dt.12-02-2018 informant is against accused Sirchan Singh. No injury has been found on the body of Birbal Singh, the son of the informant. Learned counsel has pointed out from Annexure-2 series that injury report of the informant shows that there is only one injury and as per the opinion of the Radiologist there is no bony lesion. The injury is simple in nature.

Considering the facts and circumstances, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Naugachia, District-Bhagalpur in connection with Bihpur (Jhandapur) P.S. Case No.124 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
