ANJANA MISHRA ORAL ORDER 06-04-2018 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners apprehend their arrest in connection with Deo P.S. Case No. 120 of 2017 for the offence registered under Sections 341/323/307/379/504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that admittedly the occurrence took place on account of sudden anger and there was assault on both sides. It is further submitted that only simple injuries have taken place on both sides. Learned counsel for the petitioners also points to Annexure-2, which is the FIR lodged by other side.
In view of the case and counter case between the parties and the injuries found are simple in nature, let the
Patna High Court Cr.Misc. No.16573 of 2018 (2) dt.06-04-2018 P2/ petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Deo P.S. Case No. 120 of 2017, subject to the condition as laid under Section 438(2) Cr.P.C.
