JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Case No.232 C2/2019 registered for the offence punishable under Sections 30(a) of the Bihar Excise and Prohibition Act, 2018.

As per FIR, the petitioner happens to be owner of the truck and there is recovery of 44.325 liter from the truck. Submission of learned counsel for the petitioner is that according to prosecution report only driver was present at the time of recovery and petitioner was not present and driver has been granted bail by this Court vide order dated 22.08.2019 in Cr. Misc. No.50309/2019.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five

Patna High Court CR. MISC. No.64911 of 2019(2) dt.17-10-2019 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 2nd, Jamui, in connection with Case No.232 C2/2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
