ANJANA MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 07.05.2017 in connection with Amas P.S. Case No.88 of 2017 registered for the offence under Sections 386, 387 of the Indian Penal Code, Section 25(1-b) (a), 26 of the Arms Act and Section 17 of the Criminal Law Amendment Act.

Learned counsel for the petitioner submits that from a bare perusal of the seizure list, there appears to be discrepancy/anomaly with regard to the case as the case number stands recorded therein. He further submits that it appears that the seizure list is an afterthought and cannot be accepted in the eyes of law. He further submits that there was no recovery from

Taking into consideration the fact that the petitioner is already in jail custody for more than four months and there appears to be a cloud on the prosecution story, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of Sri Gorakh Nath Dubey, Judicial Magistrate 1st Class, Sherghati, Gaya, in connection with Amas P.S.
