2. The petitioner is apprehending arrest in a case registered for the offences punishable in connection with Haspura P.S. Case No.91 of 2024 under Sections 447, 448, 341, 323, 325, 307, 504 and 34 of the Indian Penal Code.

3. As per the prosecution, the FIR has been lodged against the petitioner against whom there is allegation of assault on the head of informant's labour with iron rod.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that this case has been lodged at the instance of his unknown enemy which is apparent from the F.I.R. itself that the date and time of occurrence is about 10 AM on 26.04.2024 where the informant's labour was working as labour at her house and received injury during work.

5. Learned Counsel further submits that the petitioner

Patna High Court CR. MISC. No.75870 of 2024(2) dt.12-11-2024 2/2 was started demanding money, but was refused by the labour, then on the next day about 4:30 PM on 27.04.2024, the present F.I.R. has been lodged at the instance of unknown enemy with a view to bargain.

6. Learned Counsel also submits that antecedent of the petitioner is clean.

7. Learned APP for the State opposes the prayer for bail and submits that the F.I.R. has been lodged after delay of about 1 day which has not been explained.

8. In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Court below within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Haspura P.S. Case No.91 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
