The petitioners apprehend their arrest in Buxar Industrial P.S. Case No.115/2016 registered under Sections 457, 380 and 120(B) of the Indian Penal Code.
The informant alleged that Bitul Kumar took out ornaments from the box of the informant in pursuance of Sumit Kumar, the grand son of the informant and Bitul Kumar handed over the ornaments to his father.
Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence. There is no eyewitness to the alleged occurrence. The police submitted charge sheet under Sections 406 and 420/34 of the
Patna High Court Cr.Misc. No.17952 of 2018 (2) dt.06-04-2018 2/2 Indian Penal Code. There is no entrustment of any article to the petitioners.
Considering the aforesaid fact and nature of allegation made against the petitioners, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in connection with Buxar Industrial P.S. Case No.115/2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
