2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 324, 427, 307 and 504/34 of the Indian Penal Code.
3. The case of the prosecution is that the petitioner assaulted with a big boulder on the mouth and chest of son of the informant due to which he received bleeding injuries. From perusal of the injury report it transpires that the victim has received three injuries out of which two are of grievous nature. Four teeth of the victim were broken.
4. Learned counsel for the petitioner has submitted that there is no repetition of blow and there was no intention but the occurrence has taken place on spur of moment. The
Patna High Court CR. MISC. No.74934 of 2024(4) dt.17-02-2025 2/2 petitioner is a man of clean antecedent. The occurrence took place on a trivial issue. The petitioner is in custody since 07.08.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the above facts and circumstances, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the court of learned Chief Judicial Magistrate, Kishanganj in connection with Gardbandanga P.S. Case No. 21 of 2024.
7. Accordingly, the present bail application stands allowed.
