1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in Bakhitiyarpur P. S. Case No. 285 of 2019 registered for the offences punishable under Section 395 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of six cases and allegation is of committing road robbery. The informant alleges that he was sleeping in his truck, when all of a sudden, the unknown accused persons dragged him out of the vehicle and assaulted him by blows and punches and also robbed the informant of his purse containing Rs.3,500/- and an ATM Card.
4. The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.78510 of 2025(4) dt.16-02-2026 2/3 FIR was against unknown and the name of the petitioner transpired in the confessional statement of apprehended accused in police custody, which does not have any evidentiary value. It is also submitted that Binit Kumar @ Harsh Raj Anand had approached this Court seeking regular bail by filing Cr. Misc. No.69238 of 2025 and the same came to be allowed by an order dated 05.02.2026 passed by a learned Coordinate Bench, thus based on parity, the learned counsel seeks regular bail.
5. Learned A.P.P. Sri Chandra Bhushan Prasad vehemently opposes the regular bail application and submits that petitioner has antecedent of six cases and in the event, if petitioner is released on bail, the petitioner may abscond, on which the learned counsel appearing on behalf of the petitioner submits that petitioner will not abscond rather will face the trial.
6. On query of the Court whether charges have been framed or not, the learned counsel appearing on behalf of the petitioner fairly submits that charges till date have not been framed.
7. After hearing the learned counsel for the parties, the Court is not inclined to release the petitioner on bail taking into consideration his criminal antecedents, but then, petitioner would be at liberty to renew his prayer for bail after framing of
Patna High Court CR. MISC. No.78510 of 2025(4) dt.16-02-2026 3/3 charge.
8. The prayer of the petitioner for regular bail stands rejected with the liberty aforesaid.
