The petitioner seeks bail in anticipation of his arrest in connection with Patliputra P.S. Case No. 350 of 2017 dated 18.10.2017 instituted for the offences under Sections 147, 148, 149, 324, 307, 504, 506 and 323 of the Indian Penal Code. The petitioner along with two of his brothers and other associates is said to have assaulted the informant. So far as the petitioner is concerned, it is alleged that he assaulted the informant by means of the butt of a pistol. The other accused persons viz. Satendra and Ajay are said to have assaulted the informant by hard and blunt substances. The nature of injuries suffered by the informant does not appear to be in consonance

Patna High Court Cr.Misc. No.4378 of 2018 (2) dt.01-02-2018 with his ocular statement. Initially he was examined at the Gardiner Road Hospital where one lacerated injury was found on his scalp whereas the other injury was in the nature of bruises and swelling over the left side of his back. At PMCH where he was referred after initial treatment, no obvious bony fracture was found. Admittedly, from the FIR, it appears that there is a dispute over possession of a Dalan (Verandah).

The petitioner above named is directed to be released, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge, XIIcum-Additional Chief Judicial Magistrate, Patna in connection with Patliputra P.S. Case No. 350 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) KKSINHA/- U T
