JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kasba P.S. Case No.127/2019 registered for the offence punishable under Sections 323, 406, 376 of the IPC and 3⁄4 POCSO Act.

As per FIR, there is allegation against the petitioner of committed rape against the daughter of the informant. Submission of learned counsel for the petitioners is that there is delay in lodging of the FIR and Station Diary Entry was made against the petitioner by mother of the complainant. Heard learned APP also.

Having heard both the parties and in view of facts and

Patna High Court CR. MISC. No.64873 of 2019(2) dt.17-10-2019 2/2 circumstances of the case I am not inclined to grant anticipatory bail to the petitioner. He has to surrender and prayer for regular bail.

As such, instant petition is dismissed.
