ANSHUMAN ORAL ORDER 25-03-2023 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in connection with Sour Bazar P.S. Case No. 125 of 2022 lodged under Sections 307, 379, 384, 504, 506 and 34 of the Indian Penal Code and 27 of the Arms Act.

As per the prosecution the allegation against the petitioner is that he has fired on the back side of the informant's husband due to which he received injury. The allegation is also there in the first information report that firing has been made. Counsel for the petitioner submits that the petitioner has clean antecedent and is in custody since 18.07.2022. Counsel for the State opposes the prayer for bail and submits that for the non-fulfillment of rangdari this occurrence has occurred.

In the present facts and circumstances of the case, I

Patna High Court CR. MISC. No.69808 of 2022(2) dt.25-03-2023 2/2 am not inclined to grant bail to the petitioner. The prayer for bail is rejected.

The petitioner may renew his prayer for bail after two months of framing of charge and the trial Court shall release the petitioner after framing of charge on bail imposing his own condition(s) so that he may not evade his appearance during trial.
