JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-09-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Barun Police Station Case No. 87 of 2017, disclosing offences under Sections 341, 323, 379, 308, 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that there is dispute regarding partition of a land between the parties on account of land dispute, altercation took place and a case and counter has been lodged by both the parties as both of them have sustained injuries which is evident from annexure-4 series to supplementary affidavit. Hence, the petitioners, who are said to be of clean antecedents, deserve the privilege of anticipatory bail
Patna High Court Cr.Misc. No.40626 of 2017 (3) dt.20-09-2017 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun Police Station Case No. 87 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
