JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2022 Considering the averments made in I.A. no. 01 of 2022, filed by the respondent State as also the order dated 03.07.2017, passed by a co-ordinate Bench of this Court in C.W.J.C. no. 3211 of 2014, wherein the petitioner was private respondent no. 6, read with the order dated 07.12.2022, passed by Hon'ble the Chief Justice of this Court in M.J.C. no. 1213 of 2018, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to withdraw the present writ petition, realizing the fact that vital and actual facts have been suppressed

Patna High Court CWJC No.16881 of 2022(3) dt.21-12-2022 2/2 by the petitioner herein in the present writ petition and the fact is that the petitioner has chosen not to challenge the final order passed by the Circle officer, Maharajganj, Siwan on 06.06.2008, in connection with Encroachment case no. 06 of 2007-08, declaring him to be an encroacher, hence the same has become absolute and final, thus the encroachment in question is required to be removed immediately.

Accordingly, the writ petition stands dismissed as not pressed.
