The petitioner apprehends his arrest in Piprasi P.S. Case No.34 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The police got information that somebody has kept concealed the liquor in the field of Chhotelal Sahni and on such, raid was conducted. Two persons were started fleeing away. On chase, both were apprehended who disclosed their names as Binod Sah and Bhagwat Kushwaha. Indian made foreign liquor was recovered. Binod Sah is said to have disclosed that he got the liquor from Sohan Yadav of District-Kushinagar and he was going to deliver the same to Ajeet Mishra and Prem Sahni(the petitioner).

Patna High Court CR. MISC. No.68363 of 2019(2) dt.18-12-2019 2/2 The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. Petitioner has got no criminal antecedent. Save and except the disclosure made by Binod Sah, from whose possession the liquor was recovered, that he was going to deliver the liquor to Ajeet Mishra and Prem Sahni(the petitioner), there is nothing on record against the petitioner. Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, West Champaran at Bettiah in connection with Piprasi P.S. Case No.34 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
