JUSTICE SANJAY PRIYA ORAL ORDER 11-09-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Alamnagar (Ratwara) P.S. Case No. 92 of 2010 instituted for the offence under Sections-341, 323, 34 of the Indian Penal Code & 25(1-B)A/35 of the Arms Act. It is alleged in the written report that four persons tried to outrage modesty of the informant. The informant caught three persons and this petitioner managed to run away. As such, there is general and omnibus allegation against the petitioner. The petitioner was not apprehended on the spot.

In paragraph-3 of the petition, it has been mentioned that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.41781 of 2017 (2) dt.11-09-2017 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Alamnagar (Ratwara) P.S. Case No. 92 of 2010 to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura subject to condition as laid down u/S 438(2) of the Cr.P.C. with further conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason, will automatically cancel bail bond of the petitioners and (3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
