JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-02-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Sursand P.S. Case No. 286 of 2017, registered under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. The accusation is that, on 27.10.2017, due to quarrel four persons named in the F.I.R. including the petitioners surrounded the informant, Pawan Kumar, in the way. At that time, petitioner no. 3, Barun Singh pressed his neck through towel whereas Ram Kishore Singh caused injury at the upper side of his left eye and petitioner no. 1, Amrita Devi, also caused injury to him through iron road. Learned counsel for the petitioner submits that it would appear from the F.I.R. that there is specific allegation against Ram Kishore Singh to cause injury at the upper side of left eye of the informant and only allegation against petitioner nos. 2 is to press the neck of the informant and petitioner nos. 1 caused injury through iron rod. In fact, due to some dispute, hot talk was exchanged due to that reason petitioners have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sitamarhi, in connection with Sursand P.S. Case No. 286 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
