The petitioner has prayed for regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.

As per allegation in the FIR,while the informant was returning to his house after closing his shoes shop, in way one miscreant attacked upon him by means of knife as a result of which he sustained injuries over his waist. It is further alleged that he snatched his mobile and cash.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Police took the signature of the petitioner on plain paper and later on

Patna High Court CR. MISC. No.77687 of 2023(2) dt.05-12-2023 2/2 the same was manufactured as seizure list showing the false recovery of mobile. Petitioner claims the recovered mobile to his own. Neither the recovered mobile nor the petitioner has not been put on TIP. There is no eye witness of the alleged occurrence. Petitioner is languishing in judicial custody since 11.7.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 14th Additional Sessions Judge, East Champaran at Motihari in connection with Adapur (Harpur) P.S.
