JUSTICE ARUN KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Wazirganj P.S. Case No.248 of 2017, registered under Section 392 of the Indian Penal Code.

Allegation is that some miscreants robbed the motorcycle of the informant and also snatched cash, mobile, ATM card and other documents.

Submission is that petitioner is not named in the FIR and nothing has been recovered from possession of the petitioner. However, the impugned order shows that the robbed motorcycle was recovered from possession of the petitioner subsequent to his confessional statement.

Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.43313 of 2017 (2) dt.20-09-2017 prayer of bail of the petitioner stands rejected in connection with Wazirganj P.S. Case No.248 of 2017, pending in the court of learned A.C.J.M.-1st, Gaya.
