The petitioner seeks regular bail in Sahebganj P.S. Case No. 185 of 2017 registered for the offence under Sections 399, 402 of the I.P.C.and Sections 25(1-b)A/26 II/35 of the Arms Act. The allegation as per the F.I.R.is that while on receipt of secret information that some miscreants were planning for dacoity the police party reached the place of occurrence and on seeing them miscreants started to flee away but on chase the petitioner was arrested with loaded country made pistol. Submission of the learned counsel for the petitioner is that the he has been falsely implicated in this case. He is in custody since 26.6.2017 and he is accused in one more case and that too is of the year 2010.

Having heard both sides and in view of the recovery of arms, at this stage I am not inclined to grant bail to the petitioner. However, this application is disposed of with direction that if the petitioner remains in custody for six months or once charge is framed against the petitioner whichever is earlier, the trial court will release the petitioner on bail to his own satisfaction.
