JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2017 The petitioner seeks regular bail in connection with Budha Colony P.S. Case No. 212 of 2017, registered for offences punishable under Sections 272 and 273 of Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 270 litres of foreign liquor. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the petitioner and he has been made accused due to high handedness of the police. Further he has no criminal antecedent and has been in judicial custody since 01.07.2017. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the court below that once the charge is framed in this

Patna High Court Cr.Misc. No.39534 of 2017 (2) dt.22-08-2017 case or petitioner competes three months in judicial custody, whichever, is earlier, he shall release the petitioner on bail to his own satisfaction.
