The petitioner apprehends his arrest in connection with Belhar (Keshar) P.S. Case No. 104 of 2019, registered under Section 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act.

The accusation is of kidnapping of minor daughter of the informant by the petitioner for the purpose to perform the marriage with the help of Ravi Shankar.

Learned counsel for the petitioner submits that, in fact, Madhuri Kumari, daughter of the informant left her parental house and performed the marriage with the petitioner according to her own sweet will due to love affairs, which

Patna High Court CR. MISC. No.64163 of 2019(2) dt.22-10-2019 2/2 would appear from her statement recorded under Section 164 of the Cr.P.C. Further submission is that the victim, daughter of the informant, could not medically examined due to objection of informant and his daughter, Madhuri Kumari.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Sessions Judge-I, Banka, in connection with Belhar (Keshar) P.S. Case No. 104 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
