The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 467, 468, 471, 419, 420 and 120 B of the Indian Penal Code.
Prosecution case is that as per FIR, the informant Chanchala Kumari, Bal Vikas Pariyojna Padadhikari, Shambhuganj, Banka has filed an application before Shambhuganj P.S. stating therein that the petitioners have been new selected Anganbari Sewika of Anganbari Kendra no. 159 of Gram Panchayat Warsabad, 187 of Gram Panchayat Maldih, 177 of Gram Panchayat Bharatshila, 148 of Gram Panchayat Pakariya, 152 of Gram Panchayat Bedpur, 166 of Gram Panchayat Mirjapur and 198 of Gram Panchayat Warsabad of Shambhuganj Block on the basis of forged marks-sheet, which were
Patna High Court CR. MISC. No.65487 of 2019(2) dt.13-11-2019 2/2 manufactured by them and during the course of verification, the said marks-sheet have been found forged and on the basis of written report of Bal Vikas Pariyojna Padadhikari, Shambhuganj, Bank, this case has been registered.
Learned counsel for the petitioners submit that the vacancy was published for the appointment of Aanganwari Sevika, the petitioners and others were selected but after selection the petitioners did not join the post till date and did not withdrawn any monetary benefits. There is no documentary evidence in this regard. In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S.
