2. The petitioner apprehends arrest in a case registered for the offence punishable under Sections 302, 34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution story, the informant alleged that when his brother was sitting in his medical shop, due to previous land dispute, co-accused Chandra Bhushan Singh, Jitendra Singh and Shashi Bhushan Singh, under a conspiracy, sent Chunnu Rai and Bishundhari Rai @ Sipahi Jee along with 4 -5 unknown persons, pretending as buyers of medicines, entered the shop and it is alleged that while unknown persons asked for a medicine, Chuunu Rai and Bishundhari Rai @ Sipahi Jee
Patna High Court CR. MISC. No.69937 of 2025(2) dt.17-12-2025 2/3 resorted to indiscriminate firing causing serious injury to the informant's brother. They later, retreated. He was rushed to the Paras Hospital, Patna, where the Doctor declared him dead.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during course of investigation in the confessional statement of co-accused Ashish Kumar @ Mantu Kumar, who was also not named. The informant claims to be eye-witness and it is the specific case of the informant that co-accused Chunnu Rai and Bishundhari Rai @ Sipahi Jee made indiscriminate firing upon brother of informant causing him serious fire-arm injuries, whereas other persons, who have entered in the medical shop along with other co-accused, had only asked for medicines from informant's brother (deceased). There is absolutely no allegation of firing against other unknown persons. F.I.R. named accused persons, who are alleged to be conspirator, have already been granted bail, vide Annexure P/2. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant have opposed the bail petition.
6. In the facts and circumstances of this case, the prayer for anticipatory bail of petitioner is allowed. Let the

No.69937 of 2025(2) dt.17-12-2025 3/3 above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur (Patna) in connection with Maner P.S. Case No. 630 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure/ Section 482 of the B.N.S.S.
