JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-01-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Ram Krishna Nagar P.S. Case No. 181 of 2017 for the offences punishable under sections 147, 148, 149, 323, 341, 353, 307 and 504 of the I.P.C. Allegedly, the informant and other police personnel went to arrest the petitioner in connection with Ram Krishna Nagar P.S. Case No. 03 of 2017, the petitioner got himself closed in a room and then the informant and other police personnel were waiting, then other co-accused caused threats to the informant and other police personnel and further attacked on the police party being armed with farsa, garasa etc. resulting the petitioner fled away.

Patna High Court Cr.Misc. No.41752 of 2017 (4) dt.12-01-2018 2/2 Submission is of false implication and that in Ram Krishna Nagar P.S. Case No. 03 of 2017 the petitioner has been allowed pre-arrest bail by order dated 20.07.2017 passed in Cr. Misc. No. 29464 of 2017 by another co-ordinate Bench of this Court, in this case against the petitioner there is no allegation for attacking on the police party, no offence under section 307 of the I.P.C. is made out against the petitioner and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.

In the facts and circumstances stated above, considering that the petitioner has been allowed pre-arrest bail in Ram Krishna Nagar P.S. Case No. 03 of 2017 and in this case there is no allegation against the petitioner for attacking on the police party and as such the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub. JudgeVIII, Patna in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
