JUSTICE SANJAY KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioners and learned A.P.P. appearing on behalf of the State. The petitioners seek regular bail in connection with Bhabua P.S. Case No. 398 of 2017 registered for the offences punishable under Sections 22(a) and 27(a) of the N.D.P.S. Act. The above P.S. Case No. 398 of 2017 was registered on the basis of self statement of S.I., Bhabua Police Station. On secret information, he along with police officials reached at the place of occurrence where seeing the police party, three persons started fleeing away. Out of them, one was apprehended, who disclosed his name as Kewal Bind and from his possession, 20 Puria of brown power total weighing 5 gram. 50 mg. was recovered. The apprehended accused disclosed the name of
Patna High Court Cr.Misc. No.46912 of 2017 (2) dt.21-09-2017 2/2 these petitioners by stating that the same was supplied them. The learned counsel for the petitioners submits that the petitioner No. 1 is a disabled person and cannot be expected that seeing the police party, he would escape from the place of occurrence. The petitioners are in custody since 21.07.2017 and 23.07.2017, having clean antecedent. Except disclosure of the name of the petitioners by one of the co-accused there is nothing against the petitioners.
The learned APP for the State opposed the submission.
Considering the facts and circumstances of the case, their prayer of bail is allowed. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 398 of 2017.
