JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioners seeks bail in anticipation of his arrest in connection with Complaint Case No.347/2018 registered for the offence punishable under Sections 498(A), 323 of the IPC and 3⁄4 of the D.P. Act As per FIR, there is allegation of demand of dowry which happens to be the husband of the complainant. Submission of learned counsel for the petitioner is that allegation is false and concocted and is still ready to beep her with fully dignity.
Heard learned APP and perused, it appears from the impugned order that the realization was taken by the learned
Patna High Court CR. MISC. No.64867 of 2019(2) dt.17-10-2019 2/2 court below before whom the complainant appeared and she was ready to reside with the petitioner but the petitioner was not ready to keep her.
Considering the above conduct which is contradictory to the submission as made above I am not inclined to grant privilege of bail to the petitioner, however it is always open to reside with the petitioner and one she appear along with his wife before the court below and pray for regular bail the same shall be considered by the learned lower court below. Considering the above facts, instant petition is disposed off.
