JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This application, for grant of anticipatory bail, arises out of Muffasil P.S. Case No. 227/2019, disclosing offences under Sections 341, 323, 308, 354, 379, 504, 506 and 34 of the Indian Penal Code.

Allegation against petitioner no. 1 is of assault to the informant by Khanti, allegation against petitioner no. 2 is of assault by rod, allegation against petitioner no. 3 is of assault to the wife of informant and petitioner no. 4 is also named in the F.I.R.

Submission of learned counsel for the petitioners is

Patna High Court CR. MISC. No.64761 of 2019(2) dt.16-10-2019 2/2 that there is case and counter case between the parties and injuries sustained by the informant and his wife was found simple in nature.

Heard learned A.P.P. also as well as learned counsel for the informant, who has appeared suo motu. They have opposed the anticipatory bail of the petitioners. Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Muffasil P.S.
