2. The petitioner apprehends his arrest in a case registered for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
3. As per the prosecution case, on 26.04.2023, during a special raid near Jhakhari Mahadev, the police received information that an auto carrying liquor was approaching. The auto driver, Vishnu Kumar, attempted to flee but was caught. He admitted carrying 30 liters of country-made Mahuwa liquor for Ravi Kumar. an OPPO mobile with two SIMs was also recovered from him. Independent witnesses Vicky Sharma and Amit Kumar were present.
4. Learned counsel for the petitioner submits that he is a gas stove mechanic and the seized illicit Mahua liquor to the tune of 30 liters was recovered from a tempo which does not
Patna High Court CR. MISC. No.73078 of 2025(2) dt.16-10-2025 2/2 belong to the petitioner and further, fairly submits that the petitioner has one criminal antecedent bearing Danapur P.S. 33 of 2022 akin to the instant case but he is on bail in the said case.
5. Learned APP for the State opposes the prayer for anticipatory bail application.
6. Regard being had to the submission made by the parties, taking into consideration the fact that illicit liquor has not been recovered from the conscious possession and / or premises belonging to the petitioner, accordingly, this Court is inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Danapur, in connection with Danapur P.S. Case No. 570 of 2023 subject to the condition as laid down under Section 482(2) of the B.N.S.S., 2023. (Ajit Kumar, J) sharun/- U T
