17-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in relation to Bikramganj P.S. Case No. 86/2017 registered under Sections 147, 148, 149, 341, 323, 324, 307, 153(A), 295, 295(A), 337, 338, 353, 332, 435, 379, 427 and 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is said to be one of the members of the unlawful mob and the allegation is that the said unlawful mob was pelting brick stones on the members of the another community. Patna High Court Cr.Misc. No.7183 of 2018 (2) dt.17-02-2018 accused have been granted privilege of anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 43797/2017 and Cr. Misc. No. 32975/2017.
Learned Additional Public Prosecutor for the State is present.
Considering the facts and circumstances of this case as there is no specific allegation against the petitioner and the other similarly situated accused have been granted privilege of anticipatory bail, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) with two sureties of the like amount each to the satisfaction of learned S.J.-1st-cum-Additional Chief Judicial Magistrate, Bikramganj, Rohtas at Sasaram, in connection with Bikramganj P.S. Case No. 86/2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
