JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-09-2017 The petitioner seeks regular bail in connection with Nokha P.S. Case No. 161 of 2017, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 680 litres of country made liquor.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has no criminal antecedent and has been in judicial custody for last three and half months and other co-accused persons having similar allegation has already been granted bail by coordinate Benches of this Court vide order dated 25.08.2017, passed in Cri. Misc. No. 40848 of 2017 and vide order dated 19.07.2017 passed in Cri. Misc. No. 39143 of

Patna High Court Cr.Misc. No.42429 of 2017 (2) dt.14-09-2017 2/2 2017.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts and also in view of the fact that other co-accused persons have already been granted the privilege of bail, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II - Cum-Special Court, Excise, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 161 of 2017.

It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
