JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This application, for grant of anticipatory bail, arises out of Town P.S. Case No. 100 of 2018, disclosing offences under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 295(A), 333, 353, 153(A), 379 and 120(B) of the Indian Penal Code.

Prosecution case is that while the procession of Ram Navami was going on some anti social elements of other community pelted stones and due to which, there was stampede and members of the procession started damaging the public properties and it is alleged that petitioner was also one of the members of the mob.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no specific

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Town P.S.
