The petitioners apprehend their arrest in connection with Muffasil P.S. Case no. 175 of 2019, registered under Sections 341, 323, 307, 379 and 506/34 of the Indian Penal Code.

The accusation is that in the late evening of 20.05.2019, informant Deena Nath Prasad was engaged in serving the food in function of his villager Dinesh Prasad. At that time, Ranjeet Kumar (Petitioner No.1) started abusing and demanded Rs. 25,000/- and when he refused to give money,

Patna High Court CR. MISC. No. 64465 of 2019(2) dt.24-10-2019 2/3 then Ranjeet Kumar assaulted him by means of iron rod on his head as a result of which he sustained injury at his temporal region. At that time, Anil Prasad (Petitioner No.2) and Bipin Kumar (Petitioner No.3), father and brother of petitioner No.1, also came there having lathi and stick in their hand and they also assaulted him. At that time, they also snatched gold chain from his neck.

Learned counsel for the petitioners submits that the informant and petitioners are co-villagers. Further submission is that it would appear from the F.I.R. that occurrence is of late evening of 20.05.2019, but the present case has been lodged on 18.06.2019 after 28 days of the occurrence. Moreover, the injury found on the person of informant is simple in nature. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Muffasil P.S. Case No. 175 of 2019,
