JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Rahui (Bhaganbigha) P. S. Case No. 334 of 2019, disclosing offences under Sections 353, 323, 341, 504, 506 of the Indian Penal Code.
As per F.I.R. allegation against the petitioner of assault and tried to snatch the pistol of the informant, who happens to be the Sub Inspector.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case at the instance of the police. He has no criminal antecedent. He is a shopkeeper and ready to abide by any condition imposed upon him. Heard learned A.P.P. also.
Having heard both sides, considering the above
Patna High Court CR. MISC. No.64644 of 2019(2) dt.16-10-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Nalanda, Biharsharif, in connection with Rahui (Bhaganbigha) P. S. Case No. 334 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
