The petitioner is in judicial custody in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2018.

Allegedly, it is a case of recovery of illicit liquor from a pick-up van.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor as well as pick-up van and no any incriminating article has been recovered from the conscious possession of the petitioner as well as petitioner is in judicial custody since 06.10.2022 and

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise-I, Gopalganj in connection with Kateya P.S. Case No. 450 of 2022.
