This appeal has been filed for grant of pre-arrest bail in connection with Srikrishnapuri P.S.Case No. 94 of 2017 registered under Sections 341, 323, 376, 313, 504, 328 of the Indian Penal Code and 3(x) of SC/ST Act and for setting aside the impugned order dated 28.7.2017 passed by Additional District and Sessions Judge-II-cum-Special Judge, SC/ST Act, Patna. Allegation as per FIR is of making physical relationship with the informant and there are serious allegations against the appellants.

Submission of learned counsel for the appellants is that

Learned Special P.P., who has opposed the prayer for pre-arrest bail stating that this appeal is not maintainable. Having heard both sides and in view of facts and circumstances, let appellants, above named, surrender before the court of Special Judge and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order, preferably on the same day.
