JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2017 Earlier, prayer of bail of the petitioner was dismissed vide order dated 23.03.2017 by this Court passed in Criminal Miscellaneous No. 13656 of 2017 with observation that the petitioner may move before the court concerned itself after framing of charge.
Submission of the learned counsel for the petitioner is that after framing of charge, the petitioner prayed for bail before the court below and the same was dismissed. Except confessional statement of the co-accused Gorakhnath Mandal, there is nothing against him and he is in custody since 24.11.2016. Heard learned APP also.
Having heard both sides and in view of fact that the petitioner is in custody for about 11 months, let the petitioner,
Patna High Court Cr.Misc. No.51114 of 2017 (2) dt.15-11-2017 2/3 above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of C.J.M, Patna in connection with Kotwali P.S. Case No. 151 of 2015, subject to the conditions as follows:
(1) One of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of the court concerned.
(2) Petitioner will mark his attendance in local station in first week of every month at least for one year so that police may watch his conduct during the said period, failing which his bail bond shall be cancelled.
(3) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine
Patna High Court Cr.Misc. No.51114 of 2017 (2) dt.15-11-2017 3/3 reasons, the prosecution will be free to move for cancellation of his bail bonds.
