13-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence under Section 414/34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. One country-made pistol alongwith 2-3 live cartridges have been recovered from a car, of which, this petitioner is registered owner.

It is submitted on behalf of petitioner that no arms or ammunition has been recovered from the conscious possession of this petitioner. The vehicle in question was used by brother of the petitioner for transporting illegal arms and ammunition. Petitioner is bona-fide owner of the vehicle in question and has got no concern with the seized articles. Petitioner has got clean antecedent.
