The petitioner seeks pre-arrest bail in connection with R.P.F./Post/Bhagalpur Case No.885 of 2017 registered under Section 143(i) of the Indian Railways Act.

It is submitted that in an attempt to prevent misuse, railway ministry has introduced new checks on booking of etickets and i-tickets through IRCTC website. Under the new provisions a maximum of six tickets can be booked online by an individual user in a month on IRCTC website. So far as allegation in the FIR is concerned, it has been stated that between 01.01.2017 and 01.08.2017 forty one e-tickets were booked by the petitioner.

No.9148 of 2018 (2) dt.17-02-2018 2/2 It is submitted that even if the allegation is accepted to be true, no offence would be made out as during the period of seven months, a person is authorized to book forty two e-tickets. It is further submitted that the petitioner has got no criminal antecedent and having got roots in the society, he is not likely to abscond or tamper with the evidence.

Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Bhagalpur in connection with R.P.F./Post/Bhagalpur Case No.885 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
