The petitioner has renewed his prayer for grant of bail in a case registered under section 307 of the Indian Penal Code and sections 25(1-B)(a), 26 and 27 of the Arms Act. The earlier application for bail of the petitioner was rejected vide order dated 1.2.2022 passed in Cr. Misc. no.39031 of 2021.

As per the prosecution case, four accused persons are said to have come on two motorcycles and of having made an attempt to commit loot on the petrol pump. The petitioner was amongst the person who was caught at the place of occurrence. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide

Patna High Court CR. MISC. No.70208 of 2022(2) dt.14-12-2022 2/2 order dated 1.2.2022 (Annexure-1) passed in Cr. Misc. no.39031 of 2021, giving liberty to the petitioner to renew his prayer for bail after six months. It has been more than six months since the passing of the said order. The petitioner is in custody since 17.1.2021 and undertakes to cooperate in the trial. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the liberty granted to the petitioner in the earlier order of rejection dated 1.2.2022, more than ten months having passed since then and the petitioner having remained in custody since 17.1.2021 i.e. for 1 year 10 months, the Court directs the petitioner to be enlarged on bail in connection with Jalley P.S. Case no.11 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Darbhanga.
