The petitioners seek regular bail in connection with Delha P.S. Case No. 188 of 2023 instituted for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25 (1-B)a, 26 and 35 of the Arms Act. It is alleged that one country made katta as well as mobile phone were recovered from the co-accused. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He further submits that nothing was recovered from the conscious possession of the petitioners rather the recovery has been made

Patna High Court CR. MISC. No.73272 of 2023(2) dt.22-11-2023 2/2 from the other four persons and petitioners are in judicial custody since 07.07.2023.

Learned APP opposes the prayer for bail.

Considering the facts and circumstances of the case and submission of learned counsel for the petitioners, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM IV, Gaya in connection with Delha P.S.
