JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner seeks bail in connection with Mojahidpur (Babarganj) P.S. Case No. 216 of 2018 which has been instituted for the offences under Sections 401, 413, 414, 34 of the Indian Penal Code.

According to the F.I.R, the petitioner is said to have been apprehended along with three others with a stolen motorcycle.

Learned counsel for the petitioner has submitted that the story of recovery of stolen motorcycle is incorrect. The seizure list discloses the motorcycle to have been recovered from some other place. There is no report about the theft of any motorcycle. The petitioner

Patna High Court CR. MISC. No.71628 of 2019(2) dt.04-12-2019 2/2 has been undergoing treatment for some kind of mental disease since 2013.

Considering the aforestated facts and the period of custody of the petitioner, which is from 06.10.2018, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Bhagalpur in connection with Sessions Trial No. 117 of 2019, arising out of Mojahidpur (Babarganj) P.S. Case No. 216 of 2018.
